1. Introduction
These Terms and Conditions (“Terms”) govern the provision of security, manpower, and facility management services by ALSECURE & PROTECTION SERVICES INDIA PVT. LTD. (APS) to its clients. By engaging with APS, the client agrees to abide by these terms.
2. Scope of Services
APS provides comprehensive solutions under the following service categories:
Security Services
- Corporate & Commercial Security
- Industrial Security
- Event Security
- Executive Protection
- Arm Guard, Personal Bodyguard & Bouncer Services
- Background Verification
- Electronic Security
- Electronic Surveillance
- Valet Services
Facility Management Services
- Housekeeping
- Pantry Support Boys
- Office Boys
- Pest Control
- Lift Man Services
- Horticulture
All services are performed by trained, background-verified personnel, in accordance with applicable laws and industry standards.
3. Service Agreements
- Services are governed by a mutually signed agreement detailing scope, location, manpower deployment, terms, and financials.
- APS reserves the right to amend service charges annually or based on regulatory changes (e.g., PF, ESI, GST, minimum wages).
4. Personnel Deployment
- APS ensures all personnel are medically fit, police verified, and professionally trained.
- Uniforms, ID cards, and relevant tools are provided.
- Replacements for absent or underperforming staff will be provided within 24–48 hours.
5. Client Responsibilities
- Ensure a safe working environment for deployed personnel.
- Provide access to basic amenities such as sanitation, water, and rest areas.
- Report any misconduct, emergency, or incidents involving APS personnel immediately.
6. Statutory Compliance
- APS complies with all applicable laws and is responsible for PF, ESI, PT, GST, and other mandatory statutory requirements.
- Monthly compliance reports will be furnished upon request.
7. Confidentiality
- APS and the client agree to maintain confidentiality of all operational, business, or proprietary information exchanged during the tenure of services.
8. Payment Terms
- Payment terms will be defined in the Service Agreement.
- Delays beyond the agreed credit period may attract late payment interest at 1.5% per month.
- Any government revision in wages, taxes, or legal levies will reflect in billing.
9. Indemnification & Liability
- APS will not be liable for any loss, damage, or theft unless directly attributable to the proven misconduct or negligence of its personnel.
- Clients shall indemnify APS against all third-party claims resulting from misuse of services or non-cooperation.
10. Termination
- Either party may terminate the agreement by giving a 30-day written notice.
- Immediate termination is permissible in case of gross misconduct, legal non-compliance, or breach of contract.
11. Dispute Resolution
- Any dispute shall first be addressed amicably through mutual discussion.
- If unresolved, disputes shall be subject to the jurisdiction of the courts in Mumbai, Maharashtra.
12. Force Majeure
APS shall not be held liable for non-performance due to circumstances beyond its control, including but not limited to natural disasters, strikes, lockdowns, pandemics, or government restrictions.
13. Modifications
APS reserves the right to revise these Terms at any time. Clients will be notified in advance of any material changes.
